The primary way these two types of lawsuits differ is the way in which the plaintiffs are treated. Even though a mass tort lawsuit has many plaintiffs, each one is treated as a distinct individual. This means each plaintiff will have their own lawyer and will be required to prove certain facts to win their case. On the other hand, in a class action lawsuit, the group of plaintiffs is seen as a whole, called a class, and is represented by the same lawyer, called a class representative. USC Case: Lawsuit Information
It has been alleged that over three decades, University of Southern California’s (USC) lead administrators charged with protecting students were made aware of complaints of sexual misconduct and abuse against Dr. George Tyndall, the school gynecologist. It is alleged that they did nothing to stop him. Furthermore, they allowed the doctor to quietly resign and never reported his behavior to the proper authorities. USC officials failed to terminate him or publicly validate the victims’ claims. A recent lawsuit claims that USC turned a blind eye and that the gynecologist preyed upon vulnerable Chinese students who were unfamiliar with gynaecological exams.
